Services

We provide database performance analysis, migration programming, and related advisory work as described in each statement of work. Unless explicitly stated, services exclude 24/7 production operations, hardware procurement, and statutory audit opinions.

Quotes and acceptance

Fees are quoted in Malaysian Ringgit (MYR) unless otherwise agreed. A binding engagement begins when a statement of work is signed (or confirmed in writing by email) and any required deposit is received. Starting rates communicated during marketing are indicative only until scoped.

Client responsibilities

You provide timely access to agreed environments, accurate workload descriptions, and decision makers for approvals. Delays caused by missing access may shift timelines and, for time-based blocks, consume reserved hours.

Intellectual property

Unless the statement of work states otherwise, deliverables created specifically for you are licensed to your organisation upon full payment. Pre-existing libraries and general know-how remain ours. You must not resell our materials as a standalone product.

Confidentiality

Each party will protect the other’s confidential technical and business information disclosed during an engagement, except where disclosure is required by law.

Liability

To the fullest extent permitted by Malaysian law, our aggregate liability arising from an engagement is limited to the fees paid for that engagement. We are not liable for indirect loss of profits, data loss caused by third-party systems outside our scope, or issues present before our work began. Nothing limits liability for fraud or personal injury caused by negligence where such limitation is prohibited.

Governing law

These terms are governed by the laws of Malaysia. Courts in Kota Kinabalu shall have non-exclusive jurisdiction unless mandatory consumer protections require otherwise.

Consumer remedies

Nothing in these terms excludes statutory rights under the Consumer Protection Act 1999. Eligible consumers may refer disputes to the Tribunal for Consumer Claims for claims within its monetary limits.

Changes

We may update these terms for future engagements by posting a revised version on this site. Active statements of work continue under the terms in effect when they were signed.
